The Ten Day Letter
 In Georgia, if you arrested for a DUI, you could face two different legal issues. One is a criminal matter. The other is a civil issue. We can help you with both.
If you were arrested for driving under the influence, DUI, any of the following apply, you may have received a Form 1205 from the arresting officer:
- Your breath test result registered .08 or higher.
- You have a Commercial Driver’s License (CDL and your breath test that registered .04 or higher at the time of the incident, provided you were in a commercial vehicle at the time of the arrest.
- You declined or refused to take the test.
- At the time of your arrest, you were age 20 or under and you submitted to the state-administered breath test that registered .02 or higher.
The clock is ticking
If the arresting police officer filed the DS Form 1205 with the
Georgia Department of Driver Services, you only have TEN (10) BUSINESS DAYS to appeal the administrative suspension. Failure to file the 10 day letter could result in an automatic suspension of your driver’s license for a year with no work permit or temporary permit.
